Litigation & Investigations

PSH has the knowledge and experience to help clients understand and address the myriad local, state, federal, and international laws relating to data privacy and data protection.  In doing so, we endeavor to help clients avoid costly litigation and government enforcement actions arising out of the ever-increasing volume of data that every company grapples with.  Whenever possible, we seek to help clients properly comply with the law and minimize privacy and cybersecurity risks in the first instance.

By engaging in privacy and security risk assessments and providing counseling and advice on such issues, we assist clients in understanding and meeting their legal obligations. We also provide advice to clients on how to prepare for a cyber incident and how to address the situation if an incident occurs.

With the volume of stored data constantly increasing, and the threat from bad actors omnipresent, sometimes data breach incidents occur.  PSH defends privacy and data security claims, in both the courts and in the administrative arena. As part of a firm and practice group that focuses on business law, we thoroughly understand the context in which data issues arise, including workplace law and policy that touches on privacy.  PSH’s attorneys take on class-action litigation, regulatory investigations, and related disputes and lawsuits that frequently result from data privacy and security issues, drawing on our knowledge and experience in defending our clients’ interests.

Our team of experienced attorneys are prepared to take on numerous types of data privacy litigation and investigations, including:

  • Complying with U.S. and other privacy and data security requirements
  • Advising on development, implementation, and maintenance of privacy and data security programs
  • Responding to claims of unauthorized access to information
  • Litigating claims involving alleged violations of data security and privacy laws
  • Ensuring HIPAA compliance and managing electronic medical records
  • Addressing privacy concerns related to employee benefit plans
