Intellectual PropertyThe Intellectual Property Group advises clients about the
myriad of complex issues arising out of the identification, protection,
exploitation, commercialization, and limitation of unauthorized use of
know-how and other trade secrets, patent rights, copyrights and
trademarks. Next to employees, intellectual property is frequently the
most important asset businesses own in today’s technology driven
marketplace. Our attorneys assist our clients by identifying sources of
intellectual property in the client’s operations and establishing
programs to insure that the client obtains rights to, and appropriately
protects, valuable intellectual property developed with the client’s
time and resources. We work with inventive employees to develop
invention logs and other necessary records. Our attorneys also develop
supplemental employment agreements and non-competition agreements that
require disclosure and protection of ideas as well as limit the use of
intellectual property following cessation of employment. We provide
counsel regarding the establishment of internal controls to protect
trade secrets and ensure timely review of potential inventions and
other protectable ideas to maximize the availability of domestic and
foreign patent protection and obtain necessary registrations of
copyrights and trademarks.
We advise clients about the licensing and other commercialization of intellectual property, whether as licensors or licensees, in licensing arrangements ranging from shrink-wrap, customized or value-added reseller licenses of software to licenses of inventions and trade secrets. Additionally, our attorneys have substantial expertise pursuing infringement and other actions to enforce rights to intellectual property and in defending third party claims. Additionally, Partridge Snow & Hahn LLP offers the Intellectual Property (IP) Audit, a three step process that focuses on process analysis, inventory evaluation and action planning and implementation. The IP Audit assists a company in ensuring that it has effective policies and procedures in place to generate and protect its IP assets. It also assists a business in fully understanding the scope and contents of its IP assets so it can make full use of those assets as well as preserve and enhance their value. | |
