Creditors’ Rights

The Creditors’ Rights Group represents local, regional and nationwide creditors, banks, lending institutions, governmental service agencies and most of the major mortgage lenders regarding their creditors’ rights matters within Rhode Island and Massachusetts.

Attorneys in the Group have substantial experience representing creditors with respect to loan workouts, loan modifications, foreclosures, bankruptcies, receiverships, REO sales, and evictions. We also have extensive experience in complex mortgage servicing issues involving licensing, compliance, truth-in-lending, corporate structure, loan purchases and sales, and class action litigation defense.

Attorneys in the Group have a high degree of sophistication handling commercial and residential workouts and bankruptcies in Massachusetts and Rhode Island. We also specialize in the representation of financial institutions in the collection of deficiency judgments and the prosecution of suits against borrowers and/or guarantors as well as defending temporary restraining orders and lender liability claims. The Group complies with all investor fee and disbursement guidelines, including Fannie Mae, Freddie Mac, and VA guidelines, and with all investor foreclosure timeframes.

Additionally, the Firm is a founding member of the USFN for both Rhode Island and Massachusetts. The USFN is a national association of law firms and trustee companies that represent mortgage lenders in each of the 50 states.
