Creditors' Rights

The Creditors’ Rights Practice Group represents local, regional and national creditors, banks, lending institutions and mortgage companies regarding their commercial real estate creditors’ rights matters within Rhode Island and Massachusetts. We specialize in the representation of financial institutions in both commercial and residential mortgage litigation handling offensive actions, such as collection of deficiencies and suits against borrowers and/or guarantors, and defensive actions, such as lender liability claims and class action litigation defense.

Defaults, Workouts, Complex Mortgage Servicing Issues

Attorneys in the Creditors’ Rights Practice have substantial experience representing creditors with respect to commercial real estate defaults, including workouts, loan modifications, foreclosures, evictions, bankruptcies and receiverships. The Group also has extensive experience in complex mortgage servicing issues involving licensing, regulatory and compliance matters, truth in lending, corporate structure and loan purchase and sales.

The Firm is a founding member of the USFN – America's Mortgage Banking Attorneys for both Rhode Island and Massachusetts. The USFN is a nationwide organization of independent law firms which provide foreclosure, bankruptcy and related services to mortgage lenders.
