Stephen’s practice focuses on complex litigation that typically involves businesses, intellectual property and software licensing, telecommunications, real estate, employment, and environmental law. He tries cases in federal, state, and bankruptcy courts, and handles matters before administrative agencies.

When the Massachusetts Probation Department became the subject of a special investigation and hiring scandal, the Chief Justice of the Massachusetts Trial Courts hired Stephen to represent the Department in all disciplinary proceedings against those targeted by the investigation and federal court litigation arising from the scandal. He has represented lawyers and firms in litigation about their practices, Victorinox AG at a trial involving worldwide rights related to a Swiss Army and other trademarks, Native American phone companies against attacks by major carriers like AT&T and Sprint, and a diverse group of other clients in Massachusetts and across the country.


  • Served as a Special Assistant Attorney General representing the Massachusetts Trial Court and its Chief Justice in connection with employment practices at the Massachusetts Probation Department

Representative Cases

  • Obtained a defense judgment for one of the world’s largest conference calling companies after federal court trial in which Qwest Communications Corp. sought to hold client liable for more than $2 million for terminating access and other charges.

  • Represented the Massachusetts Trial Court, its Chief Justice, and the Commissioner of Probation in senior employee disciplinary proceedings and federal court litigation that arose from the investigation that led to the criminal conviction of the previous Commissioner of Probation.

  • Engaged as trial counsel for Victorinox AG, the maker of the Swiss Army Knife, which resulted in a successful resolution during trial of iconic rights to worldwide intellectual property.

  • Represented 20 competitors in software licensing cases against Paychex and related parties; obtained $38 million recovery after a jury verdict in one trial, a $6,200,000 jury verdict in a second trial, specific performance award in a third, and successful resolutions by settlement of all of the remaining cases.

  • Jury verdict of $1,250,000 for gender discrimination and punitive damages for the first woman chemical engineer to supervise a production line at her Fortune 500 employer.

  • Jury verdict of more than a million dollars for aiding and abetting breach of fiduciary duty against a national bank in connection with Boston historic redevelopment project.

  • Represented 50 partners in connection with the dissolution of one of New England’s largest law firms.

  • Obtained multi-million dollar recoveries for former partners regarding valuation of interests in an initial public offering for a real estate investment trust.
