Kristin counsels clients and their families on various aspects of elder law, Medicaid eligibility, and special needs planning. She also assists individuals and fiduciaries with all aspects of estate planning, estate settlement and trust administration in Rhode Island and Massachusetts. 

Additionally, Kristin works with attorneys in the Firm’s Litigation Group in handling a variety of trust and estate matters including will contests, fiduciary accountings and guardianship matters.

Kristin lives in Warwick, Rhode Island with her husband, Steve, and their sons, Stephen and Silas.

Representative Cases

  • Successfully settled several contested actions alleging incapacity of elderly individuals by children (representing elderly individual in some instances and the children in others).
  • Successfully established probate court jurisdiction over a non-resident individual in a contested guardianship matter involving “granny snatching”.
  • Negotiated mutually-agreeable long-term care solution for incapacitated elderly parent in dispute between siblings.
  • Complicated Medicaid and governmental benefits eligibility matters:  advised clients regarding establishment of special needs trust for proceeds of multi-million dollar medical malpractice settlement, advised several clients regarding interstate Medicaid issues, successfully obtained Medicaid benefits for individuals with out-of-state real estate, negotiated with state agencies regarding payment of Medicaid liens, and advised clients regarding continued eligibility for SSI and SSDI benefits.  
  • On behalf of decedent’s heirs-at-law, defeated claim of individual claiming to be the decedent’s common law spouse.
  • Successfully negotiated with an insurance company regarding the payout of an accidental death policy to the decedent’s surviving spouse instead of the decedent’s estate.
  • Secured appointment of guardians in several heavily-contested guardianship actions.
  • On behalf of trust beneficiaries, successfully recaptured life insurance proceeds which were misappropriated by the surviving spouse.
  • Secured court approval for termination of a trust and distribution plan.
  • Obtained reformation of trust department’s entire trust portfolio upon corporate restructure.
  • On behalf of parents of special needs individual, obtained approval for creation of special needs trust for child’s benefit and obtained necessary approval from state Medicaid agency and the Social Security Administration.
